Release & Waiver of Liability, Assumption of Risk, Indemnity & Parental Consent Please read carefully and sign below to indicate your agreement. IN CONSIDERATION of being permitted to participate from time to time in any or all of the following activities offered by The Gunslinger Academy LLC or any affiliate of such entities: Gridiron 7v7 League, Gunslinger QB Challenge, Perfect Timing Combines, Speed, agility, strength, Quarterback training, weight lifting Exercise/Fitness classes, and/or personal fitness training, Sport specific training (including, but not limited to, flag-football, 7v7 football, or tackle football ) Camps (collectively or individually, as applicable, referred to herein as the "Activity"), I, for myself and for my personal representative, assigns, heirs, and next of kin: Assume all of the risks of participating in the Activity, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them, or because of their possible liability without fault. Certify that I am physically fit and have not been advised to not participate by a qualified medical professional. Certify that there are no health-related reasons or problems which preclude my participation in the Activity. Acknowledge that this Accident Waiver and Release of Liability Form will be used by the organizers of the Activity and that it will govern my actions and responsibilities in connection with the Activity. In consideration of my application and permitting me to participate in the Activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) I WAIVE, RELEASE, AND DISCHARGE the Releasees (as defined in this paragraph) from any and all liability, including but not limited to, liability arising from my participation in the Activity or the negligence or fault of any of the Releasees or my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my t6raveling to and from the Activity. "Releasees" means the following entities and persons: The Gunslinger Academy LLC, gunslingeracademy.com, and each and all of their respective affinities, subsidiaries, owners, members, officers, coaches, employees, agents, contractors, sponsors, heirs, assigns, and also the owners and leassors (as applicable) of the premises on which the Activity takes place (all such entities and individuals being collectively referred to herein as the "Releasees"), (B) I INDEMNIFY and HOLD HARMLESS the Releasees from any and all liabilities or claims made as a result of participation in Activity, whether caused by negligence or otherwise, and PROMISE NOT TO SUE the Releasees for any claims made in connection with my participation in the Activity, (C) I acknowledge that the Activity may carry with it the potential for death, serious injury, and personal loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, use or condition of equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches and lack of hydration. (D) I consent and agree that The Gunslinger Academy, gunslingeracademy.com, and/or their coaches, agents, employees, representatives or volunteers may take photographs or digital recordings of me during my participation in the Activity and use such in any and all media for training or promotional purposes. I further consent and agree that my identity may be revealed therein or by description, text or commentary. I waive any rights, claims, or interest hereunder, and I understand that there will be no financial or other remuneration. This release, waiver and consent shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. THIS RELEASE AND WAIVER AND CONSENT SHALL CONTINUE IN FULL FORCE AND EFFECT FOR SO LONG AS PARTICIPANT PARTICIPATES IN ANY ACTIVITY (AS DEFINED ABOVE).
